Terms of Service

These terms govern your use of Five, operated by Hope Works LLC, an Oregon limited liability company (“Hope Works,” “we,” “us”). By creating an account or using Five, you agree to these terms.

1. What Five Is

Five is a web application that lets you select up to five YouTube creators and watch their videos in a focused interface without algorithmic recommendations, infinite scroll, comments, or view counts.

Five does not host video content. All videos play through YouTube's official embedded player. We are not affiliated with, endorsed by, or sponsored by YouTube or Google.

2. Your Account

You must be at least 13 years old to use Five. If you're under 18, you need a parent or guardian's permission.

You're responsible for maintaining the security of your account and for all activity that occurs under it. Tell us promptly if you believe your account has been compromised.

You agree to provide accurate information when you sign up and to keep it current.

3. YouTube's Terms Also Apply

Five uses YouTube's API Services and embedded player. By using Five, you are also agreeing to the YouTube Terms of Service, and your use of Google services through Five is governed by the Google Privacy Policy.

If you connect your Google account, you can revoke Five's access at any time at myaccount.google.com/permissions.

4. Subscriptions and Billing

• Free tier. Five's core experience — one Five, both feeds, the distraction-free player, and channel search — is free and always will be.
• Paid plans. Paid tiers unlock additional features such as multiple Fives, additional shelves, and extended themes. Current pricing is shown at checkout.
• Billing. Subscriptions renew automatically at the interval you select until cancelled. Payment is processed by Stripe. You authorize us to charge your payment method on each renewal.
• Cancellation. You can cancel at any time from Settings. Cancellation takes effect at the end of your current billing period. You keep access until then.
• Refunds. We don't offer automatic refunds for partial periods. If something went wrong, email us — we'll look at it case by case and try to do the right thing.
• Price changes. If we change prices, existing subscribers will be notified at least 30 days in advance. We intend to grandfather existing subscribers at their current rate where practical.
• Lifetime and promotional plans. Founder tier and redeemed promotional codes grant access for as long as Five operates as a service. They do not obligate us to operate Five indefinitely.

5. Acceptable Use

Don't:

• Use Five for any unlawful purpose
• Attempt to access accounts, data, or systems you're not authorized to access
• Scrape, crawl, or use automated means to extract data from Five
• Reverse engineer, decompile, or attempt to derive source code
• Interfere with or disrupt the service, or circumvent rate limits or security measures
• Resell, sublicense, or commercially redistribute access to Five
• Use Five in a way that violates YouTube's Terms of Service
• Share, sell, or transfer promotional codes intended for you

We may suspend or terminate accounts that violate these terms.

6. Content

• YouTube content. All videos, thumbnails, titles, and channel information displayed in Five belong to their respective creators and are served by YouTube. We claim no ownership over any of it.
• Your content. You retain ownership of anything you create in Five — your Five selections, Shelf names, and preferences. You grant us a limited license to store and display that content for the purpose of operating the service.
• Our content. The Five application, its design, its name, and its branding belong to Hope Works LLC.

7. Service Availability

Five is provided on an “as is” and “as available” basis. We don't guarantee uninterrupted service.

Five depends on YouTube's API and player. If YouTube changes its API, restricts access, or experiences an outage, Five may be degraded or unavailable through no fault of ours. We may modify, suspend, or discontinue features at any time.

8. Disclaimers

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that Five will be error-free, secure, or continuously available, or that it will meet your requirements.

9. Limitation of Liability

To the maximum extent permitted by law, Hope Works LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of Five.

Our total liability for any claim arising out of these terms or your use of Five will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) fifty US dollars.

Some jurisdictions don't allow these limitations, in which case they apply to the fullest extent permitted.

10. Indemnification

You agree to indemnify and hold harmless Hope Works LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of Five, your violation of these terms, or your violation of any third party's rights.

11. Termination

You can delete your account at any time from Settings.

We may suspend or terminate your account if you violate these terms, if required by law, or if we discontinue the service. If we discontinue Five entirely, we'll give reasonable notice and, where practical, provide a way to export your data.

Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — will survive.

12. Changes to These Terms

We may update these terms. If changes are material, we'll notify you by email or in the app before they take effect. Continuing to use Five after changes take effect means you accept them.

13. Governing Law

These terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in Oregon, and you consent to their jurisdiction.

14. Miscellaneous

If any provision of these terms is found unenforceable, the rest remains in effect.

Our failure to enforce a provision isn't a waiver of our right to enforce it later.

These terms, together with our Privacy Policy, are the entire agreement between you and Hope Works LLC regarding Five.

You may not assign these terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
